Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of ReLUfy ("ReLUfy," "we," "us," or "our"), including our website, dashboard, and connected integrations such as Google, WhatsApp, Facebook, and Instagram. By using ReLUfy, you agree to these Terms. If you do not agree, do not use the service.
ReLUfy is provided to hospitality businesses ("Customers") to manage guest reviews, surveys, loyalty communications, and conversational messaging, including via the WhatsApp Business Platform. References to "you" in sections covering account creation and dashboard use refer to the Customer; references to "guests" or "end users" refer to the Customer's own customers who interact via WhatsApp, Google, or other connected channels.
2. Eligibility and Account Registration
You must be authorized to act on behalf of the hospitality business for which you create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
3. Description of Service
ReLUfy provides a guest intelligence platform with four core capabilities:
- Data unification across connected guest data sources
- Review and survey intelligence, including sentiment analysis
- Loyalty automation and direct booking campaign tools
- Conversational messaging, including AI-assisted WhatsApp communication with guests
ReLUfy connects to third-party platforms, including Google Business Profile and Meta's WhatsApp Business Platform, Facebook, and Instagram, to deliver these capabilities. Your use of these integrations is also subject to the relevant third party's own terms, including Meta's Business Terms and WhatsApp Business Terms.
4. WhatsApp Messaging
If you enable WhatsApp messaging through ReLUfy:
- You are responsible for ensuring you have a lawful basis (such as guest consent or an existing business relationship as required by Meta's policies) to message each guest.
- You will not use ReLUfy's WhatsApp integration to send unsolicited marketing messages, spam, or content that violates Meta's WhatsApp Business Policy.
- Guests may opt out of messaging at any time, and you agree to honor such requests promptly.
- ReLUfy is not responsible for delivery failures, account restrictions, or service interruptions caused by Meta's infrastructure or policy enforcement.
5. Customer Data and Responsibilities
You retain ownership of the guest data you input into or collect through ReLUfy. You are responsible for ensuring that your collection and use of guest data, including phone numbers and message content, complies with applicable law (including GDPR and KVKK where relevant) and that you have provided guests with appropriate notice regarding automated or AI-assisted communication.
6. Acceptable Use
You agree not to use ReLUfy to: violate any law or third-party right; transmit harmful, deceptive, or abusive content; circumvent platform security; or use the service in a way that would cause Meta, Google, or any other integrated platform to suspend or restrict our access.
7. AI-Generated Content
ReLUfy's Ask module generates automated responses based on the workflows you configure. While designed for accuracy, AI-generated responses may occasionally be incorrect or incomplete. You are responsible for reviewing critical or sensitive automated communications before they are relied upon.
8. Subscription, Fees, and Term
ReLUfy is provided under an enterprise services agreement or order form executed separately with each Customer. These Terms supplement, and do not replace, any signed agreement; in case of conflict, the signed agreement controls.
9. Intellectual Property
ReLUfy retains all rights to the platform, including the ReLUfy Loyalty Index and all underlying software. Nothing in these Terms transfers ownership of ReLUfy's intellectual property to you.
10. Confidentiality
Each party agrees to protect the other's confidential information using at least the same care it uses to protect its own confidential information, and not to disclose it except as needed to perform under these Terms or as required by law.
11. Termination
We may suspend or terminate your access if you violate these Terms, including violations of Meta's platform policies that put our WhatsApp Business Platform access at risk. You may terminate your account at any time by contacting us; see our Data Deletion Policy for what happens to your data afterward.
12. Disclaimers and Limitation of Liability
ReLUfy is provided "as is." To the maximum extent permitted by law, ReLUfy disclaims all warranties, express or implied, and shall not be liable for indirect, incidental, or consequential damages arising from use of the service, including disruptions caused by third-party platforms such as Meta or Google.
13. Governing Law
These Terms are governed by the laws of Republic of Turkey, without regard to conflict-of-laws principles.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated to active Customers. Continued use of ReLUfy after changes take effect constitutes acceptance.
